Acquiring property: As a rule, EU citizens and stateless persons domiciled in the EU or Romania will be able to own agricultural and forest lands in Romania only seven years
after Romania's accession to the EU. These persons will be able to acquire land in order to establish secondary residences and/or business offices in Romania only
five years after Romania's accession to the EU. As a general rule, foreign non-EU citizens may own land in Romania if their country of citizenship has an appropriate
mutual recognition treaty with Romania. Yet, in practice, even foreign citizens may acquire pieces of land, albeit indirectly, through a company with offices registered in
Romania. The assessment base is the value of the transaction. Should there be no consideration, the tax shall be calculated based on the actual value of the real estate.
This tax is payable to the public notary on the signing date.
Agricultural and forest land: The state has the right of first refusal when forests are offered for sale. In addition, legal privileges exist for certain claims.
Land registry: In Romania, the legal relationships of rights to properties are registered in the land registry. The land registry is maintained at the court with local jurisdiction.
